PollsUp — Terms of Service

Effective date: August 14, 2025

These Terms of Service (“Terms”) govern your access to and use of PollsUp’s websites, apps, and services (the “Service”). By using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1) Who we are

The Service is operated by PollsUp, a company based in Finland (“PollsUp,” “we,” “us,” “our”).

2) Eligibility & accounts

You must be at least 13 years old (Finland’s digital consent age) or the applicable age in your country. If you are under the age of majority, you confirm you have parental/guardian consent where required.

Keep your login secure; you’re responsible for all activity on your account.

We may refuse, reclaim, or change usernames that impersonate others, violate rights, or break our rules.

3) What PollsUp is (UGC platform)

PollsUp hosts user-generated content—polls, captions, comments, votes, and photos (“User Content”). Much of the Service is public by default and may be indexed by search engines. We do not control or endorse User Content and are not responsible for it.

4) Submitting content: your rights & license to us

You own your content.

By submitting User Content, you grant PollsUp a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt (e.g., resize/reformat, add labels/tags), translate, distribute, publicly perform/display, and create derivative works solely to operate, improve, moderate, and promote the Service (e.g., showcasing how PollsUp works).

This license ends when you delete your content from the Service, except: (i) reasonable backup/log copies may persist for a limited time, and (ii) prior promotional uses may continue until retired.

Photos & responsibility for how they were taken

You must have all necessary rights and permissions (copyright, trademarks, model/property releases, venue permissions) for everything you upload.

You are solely responsible for how and where your photos were captured. PollsUp is not responsible for the legality of the capture, location access, consent, or any permissions related to people/places/objects in your photos.

Do not upload illegal content, exploitative content, or images of minors without verifiable guardian consent. Remove EXIF/GPS or other sensitive data before uploading if you don’t want it shared.

5) Poll approval, edits, and moderation

Polls may be reviewed and approved by admins before or after posting.

We may approve, reject, remove, or modify content at our discretion (e.g., to correct formatting or titles, add tags/labels such as “Sponsored,” “Reported,” “Sensitive,” or to comply with law/policy).

We may restrict or reset votes, limit distribution, or disable features to protect poll integrity and user safety.

6) Acceptable use

You may not use the Service to:

Break the law; infringe intellectual property or privacy/publicity rights; violate court orders or venue rules.

Post child sexual abuse material (CSAM), non-consensual intimate imagery, or graphic incitement to violence.

Harass, dox, threaten, or promote hate or terrorism.

Share others’ personal data without a lawful basis/consent.

Manipulate polls (e.g., fake engagement, automated voting, multi-account abuse, selling votes).

Interfere with the Service (scraping beyond our robots rules, rate-limit bypassing, reverse engineering, malware, phishing).

Impersonate others or misrepresent your affiliation.

7) Intellectual property & takedowns

Upload only content you have the right to share.

Notice & action (DSA/EU-style): Rights holders and users can report allegedly illegal or infringing content via support@pollsup.com. Include: (i) your contact info, (ii) URL(s) and description of the content, (iii) the legal or right-infringement basis, (iv) a good-faith statement of accuracy, and (v) a declaration you are authorized.

We may remove content and, where appropriate, terminate repeat infringers.

8) Voting integrity

To keep polls fair, we may use cookies, device/IP signals, rate-limits, verification steps, anti-abuse tools, and other safeguards. Attempts to evade or defeat these systems may result in penalties, including removal or suspension.

9) Sponsored content & advertising

We may show ads or label certain polls as “Sponsored.” Advertisers must follow applicable laws and our policies. Ads may appear near, around, or within the Service, including next to User Content.

10) Third-party services & links

The Service may contain third-party links or integrations. We don’t control or endorse third-party sites/services and aren’t responsible for their content or policies.

11) Feedback

If you send ideas or suggestions, you grant us a free, irrevocable, perpetual license to use them without restriction or payment.

12) Privacy & cookies

Your use of the Service is also governed by our Privacy & Cookie Policy (separate document). By using the Service, you consent to those practices.

13) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLLSUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLLSUP AND ITS OWNERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE—EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF €100 OR THE AMOUNTS YOU PAID TO POLLSUP IN THE 12 MONTHS BEFORE THE CLAIM.
Consumer protection laws may give you non-waivable rights; nothing here limits liability where it cannot be limited by law.

15) Indemnification

You agree to defend, indemnify, and hold harmless PollsUp from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your User Content; (b) your breach of these Terms; or (c) your violation of any law or third-party right.

16) Termination

You may stop using the Service at any time. We may suspend or terminate your access, remove content, or take other actions at our discretion (e.g., for policy/legal reasons or risk to users). Sections that should reasonably survive termination (e.g., licenses, disclaimers, limitations, indemnities) will survive.

17) Governing law & venue (Finland/EU)

These Terms and any dispute or claim (including non-contractual) are governed by the laws of Finland, without regard to conflict-of-laws rules.
Exclusive venue: the courts of Helsinki, Finland.
If you are a consumer residing in the EU/EEA, you also retain any mandatory consumer law protections and local venue rights that cannot be waived.

18) Changes to the Service and these Terms

We may update the Service and these Terms from time to time. If changes are material, we’ll notify you (e.g., in-app or by email) and update the effective date. Your continued use of the Service after changes means you accept the updated Terms.

Short Upload Reminder (place near your uploader)

Only upload content you have the right to share. You are responsible for how/where your photos were captured and for any permissions or releases required. We may label, limit, or remove content to enforce our rules and the law.
